JAIPUR: The state consumer forum on Monday helped a 67-year-old man to get possession of his house which he purchased from the Rajasthan Housing Board when he was just 36 years.
A bench of the forum headed by Justice Ashok Parihar, imposed an exemplary cost of Rs 75,000 on RHB for harassing the complainant and directed that he be provided possession of the his house, lying vacant for the past 30 years, within 15 days.
The order came on an appeal filed by one Madanlal and his wife. The house in Alwar was booked by the appellants in 1981. The lottery was drawn in March 1992 and in November 1992 they were informed that the housing board cannot complete the construction and they may take an incomplete house. The consent was given by the appellants on October 31, 1995 and a possession letter was issued in March 1997 without adjusting seed money already deposited.
It was alleged that when the appellants approached housing board seeking adjustment of the seed money, the board issued a fresh amended allotment letter in October 1997 computing land price based on 1993 and the construction price of 1996, forcing the husband and wife to approach the district consumer forum, Alwar.
The complaint filed by appellant was dismissed by district forum.
However, taking a serious note of the working of housing board a bench state consumer forum headed by Justice Ashok Parihar and members Anil Kumar Mishra and Sunita Ranka observed in the detailed order: "A bare perusal of the process completed by the housing board which started in 1981 and completed almost in 1997 shows the pitiable working of the housing board. There cannot be any word for depricating such pathetic working. The matter appears to be a glaring example of exploitation of a common man by a public autonomous body."
