AHMEDABAD: A court in Thangadh town of Surendranagar ordered the criminal prosecution of a woman assistant sub-inspector (ASI) for alleged custodial torture on a man after the cops received a complaint that his son eloped with a girl.

On the court's order, a criminal case was registered with a magisterial court in Thangadh against ASI Rekhaben Malkiya under IPC section 323 (assault), 341 (illegal detention), and 166A (public servant misusing power).

The court summoned the cop on Dec 16 and asked the complainant to present evidence for the framing of charges against Malkiya, saying that a prima facie offence appeared to be made out against her, said advocate Prakash Prajapati. The court ordered the criminal prosecution of the cop for allegedly beating one Dharabhai Sania on June 17 inside Thangadh police station. This happened three days after his son eloped with a girl.

On a criminal complaint filed by the victim, Thangadh police submitted a report giving a clean chit to the cop. However, under court order, Chotila police inspector conducted an inquiry under the supervision of the Surendranagar superintendent of police.

After the inquiry report, Judicial Magistrate First-Class (JMFC) A F Ansari said that the local cops tried to shield the accused police personnel in its report by recording witnesses' statements under duress.
