HC notice to Bhopal collector on contempt plea

Bhopal/Jabalpur: MP high court has issued a notice to the Bhopal collector in connection with a contempt petition, seeking a response on why revenue recovery certificate (RRC) issued by Real Estate Regulatory Authority (RERA) was not executed despite a court order. The high court had asked the Bhopal collector to get the RRC issued by RERA executed on January 24. A contempt petition was filed in the court on non-compliance of the order by Prof Sanjay Sahay, a resident of Bhopal.Sahay, in his petition, said that he had bought a plot measuring 2,400 sq feet from a construction company for Rs 8.40 lakh in 2011. Despite paying Rs 6.4 lakh to the builder, when he didn't start work to develop the plot till 2014, he filed a petition with RERA. In 2019 RERA asked the builder to return Rs 11 lakh to Sahay. Despite several applications, the money was not recovered from the builder by the office of the collector. Then, RERA issued an RRC on March 5, 2021 asking the collector for recovery of the amount. When it was not done, a petition was filed in the high court, which again asked the district collector to execute the RRC but it was not done, forcing the petitioner to file a contempt of court petition.Following brief arguments, the bench of Justice Sanjay Dwivedi issued notice to the district collector seeking a reply.
