CHENNAI: Taking judicial notice of rejection of permission by Tamil Nadu police for any form of rallies to celebrate Independence Day, Madras high court on Wednesday said that any person can organise such rallies with an intimation to police and that no prior permission is required.

“The organisers can organize such rallies in any manner (on bicycle, motorcycles or by walking). No prior permission is required. A mere intimation to the police concerned is sufficient,” Justice G Jayachandran said.

The court passed the order on a plea moved by the youth wing of Tamil Nadu BJP challenging an order denying permission for a two-wheeler rally organised by the party on Aug 15.

According to the petitioner, the youth wing of the party on Aug 10 gave an application to state police seeking permission to conduct a bike rally on Independence Day in the district headquarters across the state.

Since the application has been rejected by police, the party has moved the high court. The petitioner submitted that the permission had been denied citing ongoing construction work on roads and flyovers.

When the plea came up for hearing, additional advocate general J Ravindran submitted that the intention of the denial order was to prevent any disrespect to the national flag.

Refusing to accept the contention, the court passed the order.
