HC stays order disqualifying OSCB member from two posts

Cuttack: Orissa high court has admitted a petition challenging disqualification of T Prasad Rao Dora as member and president of the management committee of Odisha State Cooperative Bank (OSCB) and stayed the order passed by the bank’s managing director on Aug 9. The MD’s order was based on a letter issued by the Registrar of Cooperative Societies (RCS) which said Rao was disqualified to continue as member and president of the OSCB’s management committee after enquiry into financial irregularities. The court passed the interim stay order on Aug 22 and issued notice to the RCS, MD of OSCB and State Cooperative Election Commission (SCEC) on the petition filed by Rao. Senior advocate Ashok Kumar Parija made submissions on Rao’s behalf, while advocate Kali Prasad Nanda represented OSCB and SCEC. Justice Mohapatra said there is no material available on record to prima facie form an opinion that the petitioner was disqualified. “Since this court finding a prima facie case in favour of the petitioner directed for issuance of notice, the petitioner should be protected during pendency of the writ petition. Accordingly, it is directed that disqualification of the petitioner as a member and president of the committee of management of the Odisha State Co-operative Bank, Bhubaneswar, as communicated on Aug 9, 2024 shall remain stayed till the next date,” Justice Mohapatra said. The petitioner shall continue in both posts till then, he added and posted the matter on Oct 4 for further hearing.
