NEW DELHI: A Delhi court has ordered the attachment of Bikaner House, a property owned by the Nokha municipal council in Rajasthan. The order was issued because the council failed to pay Rs 50.31 lakh to Enviro Infra Engineers Private Limited as per an arbitral award.

The arbitral award, granted in 2020, was in favor of Enviro Infra Engineers Private Limited. The municipal council appealed the decision, but their appeal was dismissed earlier this year.

District Judge Vidya Prakash, who issued the order, observed that the municipal council failed to follow court instructions to provide details of their assets, as noted on September 18.

“Keeping in view the fact that the Judgement Debtor (JD) had failed to comply with the direction for furnishing affidavit of their assets despite grant of repeated opportunities, the court, while agreeing with the submissions made on behalf of Decree Holder (DH), finds it a fit case for issuance of warrants of attachment against immovable property of JD namely Bikaner House, New Delhi,” the judge said.

The court order prevents the Nagar Palika from selling or transferring the property in any way. It has also asked a representative from the Nokha Nagar Palika to come to court on November 29, the next date of hearing.
