Goa govt launches stronger witness protection scheme
Margao: Govt has announced a new Witness Protection Scheme, 2025, replacing the previous 2018 scheme. The notification dated Feb 18, issued under the Bharatiya Nagarik Suraksha Sanhita, 2023, outlines robust measures to ensure the safety and security of witnesses in criminal cases.
The scheme establishes a dedicated witness protection fund, which will be financed through various sources, including state budgetary allocations, court-imposed costs, philanthropic donations, and corporate social responsibility contributions. It will cover expenses related to implementing protection measures for witnesses and their families.
Under the new scheme, witnesses can apply for protection through both online and offline channels to the competent authority in their district. The authority must process applications within five working days of receiving a threat analysis report from the district superintendent of police, with provisions for immediate interim protection in urgent cases.
The scheme introduces comprehensive protection measures, including preventing face-to-face encounters between witnesses and accused during investigation or trial, monitoring of mail and telephone calls, and arrangements for changing telephone numbers or assigning unlisted numbers. Additional measures include the installation of security devices, identity concealment, temporary residence relocation, and financial assistance. The scheme also provides for specially designed vulnerable witness courtrooms equipped with live links and one-way mirrors, along with provisions for modifying witnesses’ voices and facial appearances during testimonies.
A significant aspect of the scheme is the emphasis on identity protection, allowing witnesses to receive new identities while preserving their existing educational, professional, and property rights. The scheme also provides for witness relocation within India when necessary.
The scheme mandates regular monitoring through monthly follow-up reports and bi-monthly meetings of the competent authority. The scheme places a strong emphasis on confidentiality, requiring all stakeholders, including police, prosecution, court staff, and lawyers, to maintain strict secrecy of proceedings.
Additionally, provisions exist for recovering expenses from witnesses who file false complaints.
