Tribunal orders Rs19L damages for cyclist who lost leg in crash
Gurgaon: A rider whose leg had to be amputated after a truck hit his cycle and ran over him in Manesar in April 2021 was awarded compensation of Rs 18.9 lakh by the Motor Accident Claims Tribunal, Gurgaon, earlier this month.Compensation will have to be paid by the insurance company. Judge Tarun Singal, in the Dec 5 order, said that Jitesh Kumar Jha was 21 years old at the time of the accident and was the only earning member of his family. "His condition is not likely to improve in the future. His happiness is lost forever. He will have to be continuously dependent upon others in all walks of life…" the judge said, awarding compensation.On April 1, 2021, Jitesh -- who worked as a record keeper with a private company in Manesar – was heading back to his rented accommodation in Rampura village. He had reached Minda Company Chowk when a truck rammed his bicycle. As he fell to the ground, his right leg was crushed under the wheel of the truck.He was rushed to ESIC Hospital in Manesar's Sector 3 for treatment, but his leg had to be amputated.Jitesh in 2022 filed a plea before the tribunal, seeking compensation of Rs 60 lakh. He argued that he used to earn monthly salary of Rs 16,000, and after becoming a victim of rash and negligent driving, he was left differently abled for life. Police investigation found that the truck belonged to Balaji Cargo Moving Transport, and the driver was Amin Khan.The driver and owner of the truck told the tribunal they were falsely implicated in the case, but did not produce any evidence to support the claim.The tribunal noted that they had not filed any complaint before the authorities for false implication and the petitioner had no motive to do so.Awarding compensation of Rs 18.9 lakh, the tribunal said that Jitesh's injuries will reduce his life expectancy and standard, other than causing hardship to his family.
