Telangana high court dismisses writ petition after multiple adjournments in bank loan recovery case

Hyderabad: Seeking multiple adjournments in a writ petition resulted in the dismissal of the petition itself. Noting that the petitioners, a couple from Jubilee Hills, did not appear to be interested in proceeding with the matter, a division bench of the Telangana high court dismissed their petition. The petition was filed challenging recovery notices issued to them by UCO Bank over a pending loan.

The petitioners, an advocate and his wife, filed the petition before the high court in February 2025 to cancel the recovery notices issued to them by the bank on January 13 and 18, 2025, respectively. They claimed that the notices did not mention the claim amount of the loan obtained on a property.

They also asked the court to cancel all other legal proceedings initiated by the bank against their property based on a loan agreement made in March 2013. The couple also claimed that the loan agreement was fake and invalid, and any action based on it should be declared null and void from the beginning and not legally enforceable.

Further, the couple sought compensation from the bank for the harm caused by the bank’s alleged fraudulent acts. They also alleged that the bank tried to illegally take over their valuable property by violating RBI rules and other laws.

“The bank used deceptive tactics and deliberately harassed us, causing mental stress, defamation, financial loss, and damage to our reputation,” the couple alleged.

When the matter came up for hearing before a division bench of Justices Moushumi Bhattacharya and BR Madhusudhan Rao on Thursday, the petitioners’ counsel did not appear before the bench. Recording the counsel’s absence, the bench observed that the petitioners had already taken five consecutive adjournments in the matter. Noting further that they did not seem to pursue the matter, the bench dismissed the petitions.
