T HC declines to stay no-trust against municipal chairpersons

Hyderabad: The Telangana high court on Friday declined to stay the ongoing no-confidence motions moved against chairperson/vice-chairperson of various municipalities, including Bhuvanagiri and Khagaznagar. However, the court issued notices to collectors asking them to file counters within eight weeks.
Justice Tadakamalla Vinod Kumar was dealing with pleas filed by the aggrieved chairpersons who contended that collectors were unilaterally allowing no-trust motions on ‘baseless’ complaints.
“One councillor files a complaint after defecting to the ruling party and that is becoming the basis for a no-confidence motion. The process adopted by the collectors was contrary to the provisions of Municipalities Act, 2019, and guidelines laid down pertaining to appointment and removal of chairpersons and vice-chairpersons,” the petitioners alleged.
Though the court refused to stay the process, it issued notices to the collectors.
The Judge also refused to accede to the request of former chairperson of Nalgonda municipality, Mandadi Saidi Reddy, to reinstate him. He had lost the floor test after a no-confidence motion was moved by some councillors on January 8. Following this, the collector appointed Abbagoni Ramesh as chairperson. Saidi Reddy has challenged the collector’s decision. The court has issued notice to the collector asking him to file his counter.
