Forgery case: Courtjunks anticipatorybail of 8 accused

Kanpur: Additional Sessions Judge, Courtroom No 1, Kanpur Nagar, Sapana Tripathi, on Saturday dismissed the anticipatory bail applications of eight accused of forgery, cheating, fabrication of forged documents and conspiracy (U/s 419/420/465/466/467/468/469/471 read with 34 and 120B IPC).The bail applications were submitted by Girish Chandra, Atul Katiyar, Arvind Kumar, Mukesh Chandra Katiyar, Sunil Kumar Katiyar, Rakesh Kumar Katiyar, Arjun Singh and Umesh Chandra.
Presiding judge observed that Atul Kumar Katiyar and Mukesh Kumar Katiyar were directors of the company, while the other accused were shareholders. The company started its function with Certificate No 20-25618, and on its basis, prepared a forged document of Bharat Oil & Gas Corporation Ltd and published advertisements in various newspapers for allotment of a gas agency.They collected money from aspirants and prepared forged licences of prominent govt owned petroleum companies, using their logo similar. On the basis of evidence collected by the investigating officer, police filed a chargesheet against the accused and the investigation began.Memo of the case diary stated clearly that the accused were absconding. The court had already issued non-bailable warrants against them. Apart from this, the IO urged the SP Economic Wing to declare a reward for their arrest. It was evident that the accused were not co-operating in the investigation and there were no grounds for granting them anticipatory bail.The accused, in their application, submitted that they were innocent persons and were framed in the case. The investigation against had not found anything against them and they had neither any criminal history, nor would they misuse bail if granted.Additional District Govt Counsel, Pradeep Sahu, pleaded that people applied in response to their newspaper advertisements and the accused asked them to deposit money for a licence and raise infrastructure for the agency.
