MUMBAI: A 51-year-old auto rickshaw driver found guilty of beating a BEST driver with a baton in a 2008 road rage incident, leaving him with head injuries, has been let off with a Rs 10,000

fine

.

Finding Pravin Amnerkar guilty, the sessions court said, “Having regard to the facts and circumstances of the case, the nature of the offence, the age and antecedents of the accused, and also the fact that the incident was apparently an outcome of the sudden fit of anger, this appears to be a fit

case

to let the accused suffer sentence of fine only.”

The court noted that the incident occurred more than 12 years ago, and in such circumstances, no purpose would be served by committing the accused to prison. “At the same time, considering his audacity to assault a public transport bus driver, the fine also need not be meager but should be commensurate with his deeds,” the court said. The victim Rajesh Chavan remained untraceable and the prosecution relied on the statements of the bus conductor, investigating officer and medical officer.
