NOIDA: The additional district and sessions court has sentenced a man to four years of imprisonment under the
Pocso Act for sexually assaulting a 13-year-old boy in Noida in 2018.
The boy’s aunt had filed a complaint against
Sunil Kumar, a resident of Auraiya district who was staying in Noida, in Phase 3 police station. According to her, she had invited some relatives on her daughter’s birthday on September 5, 2018.
“My nephew, (13), had also come to our place. He has a learning disability. That night, around 9pm, the family had gone to sleep when my nephew went missing,” the aunt said.
The family then launched a search in the neighbourhood and found him at Kumar’s house. “He had sexually assaulted the minor,” Neetu Bishnoi, the special public prosecutor, said.
A case was registered against him under sections 377 (unnatural offences) and 511 (punishment for attempting to commit offences punishable with imprisonment for life or other imprisonment) of
IPC
and sections 7 (sexual assault) and 8 (punishment for sexual assault) of the Pocso Act. Police later arrested Kumar.
Niranjan Kumar
, additional district and sessions judge, acquitted the man under IPC sections 377 and 511 for lack of evidence, but convicted him under sections 7 and 8 of the Pocso Act on Monday. The court sentenced him to four years of imprisonment and imposed a fine of Rs 1,000 on him.
