VIJAYAWADA: The Andhra Pradesh high court on Thursday issued notices to the state government and the de facto complainant to file counter affidavits in the petition filed by YSRC rebel MLA Kotamreddy Sridhar Reddy seeking to quash the case registered against him by Vedayapalem police under the charges of SC/ST Act (prevention of atrocities), attempt to murder, kidnap and other sections of IPC.
The high court observed that further proceedings cannot be stayed in a case registered under SC/ST Act without giving notices to the de facto complaint.
Arguing on behalf of Sridhar Reddy, T Nagarjuna Reddy told the high court that the police included Sridhar Reddy as an accused four months after the registration of the crime. There is no material against Sridhar Reddy in the complaint lodged by one Matangi Venkata Krishna who alleged that some YSRC workers abducted and thrashed him..
Arguing on behalf of the state government, additional advocate general P Sudhakar Reddy said that the case was registered under sections 307 of IPC and SC ST Act. According to Supreme Court guidelines, investigation cannot be stayed without hearing the de facto complainant.
Considering the arguments on both sides, the high court issued notices to the state government and the de facto complainant to file counter affidavits and posted the matter for further hearing after two weeks.
