Mumbai Magistrate court rejects bail applications of Aryan Khan and 2 others

Satish Maneshinde concluded his submissions on Aryan Khan bail by reading a judgment of Harsh Sawhney from Supreme Court and summing up, “The two grounds which will entitles me for bail are fulfilled.”

Defending Aryan, the lawyer stated that the star kid comes from respectable family, he has roots in the society, his parents, siblings all are here and that Aryan also holds Indian passport and that he will not abscond. Satish Manshinde further argued that there was no question of tampering of evidence or accused and concluded stating that electronic evidence was already taken and that the other accused are still in custody.

The senior advocate has claimed in court that apart from questioning on day 1 nothing else has happened after Aryan was arrested. Satish Maneshinde has claimed that in the last five days nothing has emerged. Aachit was revealed on first day, they took their own time and Aachit was remanded yesterday, he stated. He further argued in court that Justice Krishna Iyer had said corroboration, confrontation, interrogation can take place in absence of custody of the accused. The lawyer stated that these judgments have been considered time and again that normal tendency of the court is to grant bail if no serious crime and that nothing would emerge as there is nothing.

Maneshinde argued in court that when the NCB asked Aryan if he had drugs on him, he denied it. The senior advocate also stated that despite Aryan’s denial, the investigating agency searched Aryan, his bag and his closes and also perused his phone, in a bit to find something to interrogate Aryan.

Satish Maneshinde says that he is submitting a small chart on the judgments he cited and how they can be differentiated. He also explained that based on facts, Aryan Khan is 23-year-old with no prior antecedents and that he happens to be a part of Bollywood and hence he reached the International terminal.

Maneshinde: So he will cite Rhea and I will cite Stephen.I did not ask for bail as a matter of right. I let go off that on the first day. I did not ask for bail on first day. I thought they will take a linear view considering that there is no material against me.

Maneshinde - I am not claiming bail as a matter or right. I didn't claim it on the first day because I thought NCB officers would take a lenient view. I submitted myself to their custody. But there is no material (against me), even in messages. They have my (Aryan's) WhatsApp messages which your honour has disregarded for judicial custody
