'Image of country ... ': SC slams states, UTs on stray dog case; chief secretaries told to appear on November 3
NEW DELHI: The Supreme Court on Monday pulled up states and union territories for failing to comply with its directions on the stray dog menace and ordered the personal presence of their Chief Secretaries on November 3, noting that the issue if affecting country's image.
The court noted that only the Municipal Corporation of Delhi and the governments of West Bengal and Telangana have filed their affidavits so far. It directed that, except for these three, Chief Secretaries of all remaining states and Union Territories must appear before it, at 10.30 am next Monday, with an explanation for not submitting their compliance reports.

The bench also observed that the Delhi government itself has not filed an affidavit and instructed its Chief Secretary to be present in court as well on November 3.
"Continuous incidents are happening and the image of the country is being shown as down in the eyes of foreign nations," said Justice Nath, heading the three-judge bench. When a counsel pointed to instances of cruelty against dogs, the Court retorted, “What about cruelty towards humans?," as quoted by Bar and Bench.
The court expressed concern over the continued rise in incidents of stray dog bites and the lack of compliance by most states with its directions, adding that its August 22 contained everything.. Noting that only three authorities had submitted their responses so far, the bench observed that the issue required urgent attention and accountability from state administrations.

“The menace of stray dogs continues across the country despite repeated directions,” the bench remarked, calling the inaction of states “unacceptable.”
The apex court is monitoring the implementation of measures to manage the growing population of stray dogs and prevent attacks on citizens. It had earlier directed all states and union territories to file status reports on sterilisation drives, vaccination efforts, and rehabilitation mechanisms for stray animals.

Who all are responsible for making lives of Indians unsafe?1. Smt M Gandhi (Union State Min of Culture in 2001) who.notified ABC (Canine) Rule 2001 which permitted strays.2. Shri Lalan Singh (Union Min of Culture) who has notified ABC Rule 2023.3. Supreme Court judges which has overlooked primacy of States' Municipal Corporation Acts which provide for culling or impounding of strays. These Acts have all been legislated in State Assembalies & approved by President of India. Where as ABC Rules have been issued based on authority of PCA Act Section 38 (1) which permits Union to make Rules only pertaining to cruelty to animals. Prevention of straying of strays is not cruelty. ABC Rule permits straying of canines only & no other animal. At one end, Min.of Animal Husbandry keeps repeating instructions to States to control strays but at the other end Union Govt's ABC Rule does not permit culling or impounding of strays. PCA Act Section 11 (3) (b).provides for destruction of strays. It is beyond logic how ABC Rule, issued on.authority, can override provision.of parent Act itself. PCA Act was legislated by Parliament & approved by President of India. It's a statutory provision..ABC Fule is merely a bylaw.4. State Govt's are not asserting their mandate of controlling stray animals. They must demand Union.Government to.recscind ABC Rule as it is unconstitutional..Lastly, blaming Corporations & Administration will.not any purpose.. it is not possible to.vaccinate & sterilize over 6 crore canines at a pace which would commence reduction.of stray population.Read allPost comment
