9 basic laws all landlords and tenants must know

Rental housing is common in many cities, and a clear understanding of landlord-tenant laws helps prevent disputes and misunderstandings. In India, rules related to renting are mainly governed by state rent control laws and broader frameworks such as the Model Tenancy Act, 2019, which aims to balance the rights and responsibilities of both property owners and tenants. Knowing these basic legal principles helps ensure fair treatment, transparency, and smoother rental relationships.

A written rental agreement is essential

A rental or lease agreement is the foundation of any landlord–tenant relationship. It clearly states the rent amount, security deposit, duration of tenancy, and rules for using the property. A written agreement protects both parties legally and helps avoid disputes in the future. Many modern tenancy laws also require agreements to be registered or reported to authorities to ensure transparency.

Landlords have the right to receive rent on time

The first and foremost right of a landlord is that he should receive the rent in time as mentioned in the agreement. If the tenant fails to pay the rent in time, the landlord can send a legal notice or can take action through proper channels. The failure to pay rent in a consistent manner can also be a reason for evicting the tenant from the property.

Tenants cannot be evicted without legal process

A landlord cannot evict a tenant without following due legal process. The landlords should send a notice and get a court order before evicting a tenant. The tenant can be evicted only for specific reasons such as failure to pay rent, misuse of property, and breaking the terms and conditions.

Landlords must provide basic living facilities

The landlords are also responsible for ensuring that the house is habitable. This means that the landlords must ensure the house is provided with basic amenities like water, electricity, and sanitation. Without such amenities, the tenants can demand repairs or seek legal action against the landlords. A habitable environment is one of the legal requirements.

Security deposit rules must be followed

Most rental arrangements require tenants to pay a security deposit before moving in. This amount acts as protection for the landlord against property damage or unpaid dues. However, the deposit must be reasonable and clearly mentioned in the agreement. After the tenant vacates the property, the landlord must return the remaining deposit after deducting legitimate repair or utility costs.

Rent increases must follow proper notice

Landlords generally cannot increase rent abruptly during the tenancy period. Rent revisions must follow the terms stated in the rental agreement or applicable tenancy laws. In many cases, landlords must provide written notice in advance before increasing rent so that tenants have enough time to prepare or negotiate new terms.

Tenants must use the property responsibly

The tenants are expected to take good care of the property and ensure that they are using it for the intended purpose only, as agreed upon in the contract. The damage of property, disturbance of peace, or usage of property for illegal activities may result in legal consequences against the tenants. The proper usage of property helps create confidence between tenants and landlords.

Subletting usually requires landlord permission

The term "subletting" is used when a tenant lets the property to another person, remaining a tenant themselves. In most cases, tenants are not allowed to sublet the property unless they take prior permission from the landlord. The unauthorised subletting of property can be considered a violation of the contract, resulting in legal consequences against the tenants under various rent control laws.

Landlords have the right to reclaim property under valid reasons

The landlords can also take back their property under certain conditions like when they need the property for their own use or when the tenants have breached certain key terms of the rental agreement. However, all of this is done following certain legal procedures so that a sense of justice is maintained.

It is important for both landlords and tenants to understand some of the basic laws that govern their rental agreements. These laws are important for the maintenance of fairness, respect for property ownership and safety. By following legal procedures, rental agreements can be made smooth and trustworthy for both parties.
