Prolonged jail vs speedy trial in UAPA cases: Will SC finally settle the debate?

The latest judgment faulted two earlier rulings, holding them inconsistent with the landmark February 1, 2021 verdict by a three-judge bench of Justices N V Ramana, Surya Kant and Aniruddha Bose, which ruled that UAPA’s stringent bail conditions cannot be “used as the sole metric for denial of bail”



Should bail be the rule, even under stringent laws like the Unlawful Activities Prevention Act (UAPA) that often result in prolonged incarceration, or remain an exception? This question may soon come before a five-judge Constitution Bench of the Supreme Court, with Delhi Police expected to seek a larger bench ruling amid conflicting judicial precedents.
