‘Dowry death’: MPHC reserves order on pleas seeking cancellation of Giribala bail
Bhopal/Jabalpur: A vacation bench of Madhya Pradesh High Court on Wednesday reserved its order on the plea to revoke the anticipatory bail granted by the trial court to former district judge Giribala Singh in the Twisha Sharma ‘dowry death’ case.
Giribala was named as an accused in the death of her daughter-in-law, model-turned-actor Twisha, under suspicious circumstances at her matrimonial home at Bhopal’s Katara Hills on May 12 night. He co-accused lawyer son Samarth, surrendered to the police after being denied pre-arrest bail and is currently in CBI custody.
Twisha’s father and the Madhya Pradesh govt filed separate pleas before the HC seeking cancellation of bail to Giribala.
The vacation bench of Justice Dev Narayan Mishra heard arguments from lawyers representing the state govt and Twisha’s father over three and a half hours.
The counsels for the state and Twisha’s father argued that Giribala was flouting the bail conditions laid down by the sessions court. She was served five notices by Bhopal police between May 13 and May 23 to which she didn’t respond.
She also addressed a press conference on May 18 purportedly casting aspersions on Twisha’s character upon her death. It was alleged that she was not allowing the investigating agencies to access the ‘physical evidence’ at her home.
After hearing the arguments, the bench reserved its order on the petitions.
The CBI, which has taken over the probe into the death, moved an application to be an intervenor in the case, which was also granted by the single bench.
Meanwhile, a local court on Wednesday transferred custody of Twisha’s husband, Samarth Singh, to the CBI till May 29. After taking over the probe, the CBI moved court seeking transfer of custody from Bhopal Police.
The CBI also took Samarth to his house and recreated the scene on the night she was found dead.
