CHANDIGARH: Punjab and Haryana high court on Friday vacated the stay on declaration of results for ward no 19 for general elections of Chandigarh municipal corporation.
The stay was set aside by a division bench headed by Justice M M Kumar while hearing an appeal filed by
election commission. Earlier on Wednesday, a single bench headed by Justice M S Sullar had put a stay on declaration of election result of the ward.
Arguing for the election commission, advocate Sanjay Kausal submitted that once the election process has been set in motion writ petition ordinarily would not be maintainable. In order to support his submission, Kaushal, had placed reliance on the bar created by Article 243-ZG (b) of the constitution.
Earlier, the stay orders were passed by the single bench after hearing a petition filed by a person namely Ravi, who claimed he had submitted his nomination form on November 25 as an independent candidate for the upcoming MC polls.
Election commission on Friday submitted there was no such candidate named Ravi, who filed his nomination paper from ward 19. The allegations made in Ravi's writ petition, therefore, were considered false and misleading the court.
