HC concern over filing of forged docus to get relief

Cuttack: Orissa high court has expressed concern over the filing of forged medical documents, date of birth and school certificates before the court to get relief in different cases and has urged lawyers and clerks to verify them before they are placed on record.The two-judge bench of Justices S K Sahoo and Chittaranjan Dash said that most of the time, the advocate’s clerks submit an affidavit while filing such documents, for which they are held accountable in case of any forgery. But affidavits are filed by clerks while reposing faith in their advocates, and the court trusts them.

Let alone affidavits, the courts do not think twice about the authenticity of documents submitted, the bench observed, adding, “Hence, it is the responsibility of the advocate and advocate’s clerks to bring the correct state of affairs before the court and their attempt should not be to misguide the court in any manner.”The observation came while the court was hearing a criminal contempt proceedings in a case on Sept 24 in which a forged school transfer certificate was detected by a lawyer in an appeal by a murder convict seeking quashing of the trial court’s order for life imprisonment on the ground that he was a minor at the time of the crime. The forged document was provided by convict Sanatan Hessa’s brother-in-law, Gania Gagarai.The bench had initiated criminal contempt proceedings against Gagarai and ordered his detention in jail custody from Sept 3. Contempt proceedings were dropped and Gagarai’s release was ordered after he tendered an unconditional apology on Sept 24.“If the advocate or the advocate’s clerk has no personal knowledge about a particular document which is produced by a party, then it is to be verified properly before bringing the same on record and it is also better to ask the concerned party to swear on the affidavit,” the bench said, while dropping the contempt proceedings. Advocate Nityananda Panda stated in an affidavit he had accepted the document in good faith and annexed the same to the interim application, along with the appeal.
