HC stays order against admissions in 12 pvt industrial training centres

Cuttack: Orissa high court has imposed restriction on orders issued by the Directorate of Technical Education and Training (DTET), Cuttack restraining 12 private industrial training centres (ITCs) from admitting students for 2024-25 on grounds of lack of infrastructure and other facilities.The HC gave the relief after a preliminary hearing on petitions filed by the 12 institutions on Aug 28. The petitions sought intervention against the DTET orders issued on July 3 and Aug 5.The two-judge bench of Chief Justice Chakradhari Sharan Singh and Justice Savitri Ratho said, “We have been informed on behalf of the petitioners that substantial admissions have already been given by these ITCs before DTET issued the orders. In that background and considering the nature of communications dated July 3 and Aug 5, also in the background of the fact that these ITCs claim to be permanently affiliated, we direct that in the meanwhile, the petitioners-institutions shall be at liberty to give admission to the trainees which shall be subject to final adjudication in the present cases.” “The ITCs/petitioners-institutions shall be under the obligation to inform the trainees, who are given admissions, that such admissions, are subject to final adjudication in the present cases and their admissions shall not create any equity in their favour or in favour of these institutions,” the interim order said. The institutions include four in Puri, two in Rourkela and one each in Dhenkanal, Rajgangpur, Sundargarh, Ganjam, Balasore and Jajpur. During the preliminary hearing, senior advocate Pami Rath and advocates Sanjay Kumar Das and Rehena Khatun appearing for the petitioner institutions argued that they should be allowed to give admission for the academic year 2024-25 subject to final adjudication of the present cases since after the cut-off date of Aug 31, they cannot admit students. State counsel Suman Pattnaik submitted that there is no illegality in the final orders as communicated to these institutions as the decision was taken after inspection was carried out in the presence of the functionaries of the ITCs. However, the bench said, “We are prima facie satisfied with the submissions advanced on behalf of the petitioners to the effect that the said communications dated July 3 and Aug 5 are violative of principles of natural justice inasmuch as the specific reasons/deficiencies were not made known to these institutions before restraining them from admitting the students for the academic year 2024-25.”
