new delhi: the rs 64-crore bofors pay-off case was adjourned on monday after the hinduja brothers once again complained about the deficiency and illegibility of the documents supplied by the cbi. their advocates submitted a list to special judge s l khanna and demanded that the investigating agency should make available the deficient documents. while giving a detailed application regarding the inadequate documents, the counsel explained: "documents referred by the witnesses in their statement have not been provided to us.
also, if the cbi has relied upon a paragraph of a document, they have provided us the photocopy of that paragraph only, but not the complete document." the cbi sought time to reply to the complaints of hinduja brothers. while asking the agency to file the reply on september 18, the judge told them to prepare all the deficient documents, as complained by the defence counsel, and submit them on the next date of hearing. the judge, however, specified that he would not grant more time to the defence to scrutinise the documents. except for the hinduja brothers, the other accused in the case do not have any complaints with the availability of documents. on the last date of hearing the judge had refused to grant more time and had asked a b bofors to finish its inspection and scrutiny by august 22. the hinduja brothers were asked to scrutinise the papers after august 22 to august 31. on monday, the judge was also informed about the supreme court judgment permitting the eldest brother, s p hinduja, to go abroad. the permission was granted after the youngest brother, p p hinduja, returned to india on the date as fixed by the apex court. the third brother, g p hinduja, is still abroad. since s p hinduja's bank guarantee is valid till september 30, he has been directed to return to india on or before that date. the cbi has filed two chargesheet in the bofors pay-off case. the agency has accused the hinduja brothers, former bofors agent win chadha, the company a b bofors, its chief martin ardbo, italian businessman ottavio quattrocchi and former defence secretary s k bhatnagar of earning kickbacks in the rs 64 crore pay-off case. at the direction of the delhi high court, the lower court had separated the trial of hinduja brothers, win chadha, bhatnagar, a b bofors from the trial of quattrocchi and ardbo. according to the cbi, the agency is fighting for quattrocchi's extradition in a malaysian court and a red corner alert notice has been issued against ardbo.
