KANPUR: The National Human Rights Commission (NHRC) recently took cognizance of a complaint of one Raju Rathore and issued a notice to the Kanpur Nagar SSP in a case related to illegal detainment of former's son. The NHRC has asked the SSP to send a reply/report on Rathore's complaint within one week from the date of receiving the notice.
The commission, in its notice issued on October 20, 2011, also warned the senior police official that if found guilty, it may proceed to take such action against him.

Raju Rathore, a resident of Mathuri Mohal near Central railway station, had alleged in his complaint that the government railway police (GRP) of Kanpur had caught his minor son Arun Rathore and his friends Raj Kishore and Salman Ahmad on the intervening night of October 8 and 9, 2011, when the trio were witnessing a Devi Jagran programme in the area.
GRP constable Arvind Singh, with the help of others, had dragged the kids and took them to the GRP station on platform number one and put them in the lockup.
His manhandling act was recorded by the CCTV cameras installed in the tunnel of railway station, Rathore said in his complaint.
He and parents of other kids reached the station within a few minutes and urged to release the kids but Arvind and other cops on duty refused. They not only abused the kids but also thrashed them mercilessly. Rathore claimed that he and other parents tried to contact the senior police officials but all their efforts went in vain.
Thereafter, Rathore sent telegrams to NHRC and Union home minister (New Delhi) disclosing.

The GRP, on the other hand, fabricated a case and showed the kids' arrest under section 41/109 CrPC at 11.30 am. In his detailed complaint, Rathore claimed that Kanpur GRP had detained his son and others illegally for 11 hours which was a violation of their human rights.
Moreover, the police had handcuffed the kids and produced them before the additional chief metropolitan magistrate's court. The presiding judge witnessing the age of kids and going through the documents had released them on personal bonds.
Rathore said that all kids were unable to move due to thrashing by cops. Moreover, the fabricated case could affect the career prospects of the kids. The cops had threatened him and other parents of dire consequences if they took any legal action against them.
The telegrams and detailed complaint were presented before the NHRC on October 19. The NHRC issued notice to Kanpur Nagar SSP on October 20 with a direction to submit a report within one week after receiving the notice.
