KOLKATA: Activist Subhas Datta and the CESC have jointly moved the Calcutta high court on Monday, seeking an appropriate change to its earlier order, restricting the Indian Botanic Garden (IBG), Shibpur, from digging its garden only for preservation or maintenance. The earlier order was issued on a PIL filed by Datta.
Large parts of Howrah face frequent power cuts and the CESC needs permission to dig the garden and replace its high tension cable.

However, the IBG authority has been citing the high court order whenever the CESC seeks permission to dig the garden. The IBG contends that allowing the CESC to work on its high tension cable would violate the HC order as it would not be for the garden's preservation or maintenance.
The CESC roped in Datta to file a joint plea in the division bench of Justice Pinaki Chandra Ghosh and Justice Shukla Kabir Singh, praying for an alteration to the order. The bench has fixed Wednesday, March 9, as the next date of hearing.
