MUMBAI: Observing that such offences cause a sense of shock and insecurity to the public servants in society, a sessions court recently sentenced three unemployed men from Goregaon to a month's imprisonment for creating nuisance at Andheri police station under the influence of alcohol in 2018.
The court refused to let off the accused on a bond of good behaviour under the Probation of Offenders Act.

"Keeping in view the grave nature of the offence committed under the influence of liquor, this court does not consider this case to be a proper case to exercise discretion to grant the benefit of probation or admonition to the accused," the court said.
Under the Probation of Offenders Act, an accused can be released on a bond of good behaviour instead of serving a sentence. The accused were granted bail on February 6, 2019 after spending over a month in jail. "Since the accused have already undergone the substantive sentence.... shall be set free immediately, if not required in another case," the sessions court said.
The court said that there is evidence that on December 27, 2018 at around 10.30 pm the accused Manish More (30), Abhinav Tapkirkar (30) and Sainath Mane (25) were loitering at Metro Hotel, Andheri (East) and were creating nuisance there. Thereafter they were brought to the police station. The accused, under the influence of alcohol started shouting, uttering abusive words at the police station, behaving arrogantly, making offensive expressions and gestures and unreasonable noise.
"When they were pacified by the higher authorities, they did not listen to anyone and pulled the crime register in the custody of Police SubInspector Pagar and shouted," the court said. The court further said that when the police naik asked them to keep quiet, the accused scuffled with him, and threatened that they would not spare anyone.
