Suresh Kumar on Monday defended speaker K G Bopaiah's decision on disqualification of rebel MLAs, saying the apex court is not infallible.
"The SC is supreme. But it is not infallible. If there were any higher body, we don't know how it would have viewed the case," the minister said. "There are certain contents in the SC ruling that cannot be agreed upon.
But since there is no appeal, it is final," he said arguing for the speaker.
Speaking to reporters he said: "The speaker has quasi-judicial powers and he gave an opportunity to the MLAs, who argued their cases before him through their lawyers. It is not that they were denied a chance to present their case." Referring to the high court verdict on disqualification, the minister said, "The five judges of the HC upheld it."
On the Union government's decision to issue an advisory to the state government to look into the issues raised by governor H R Bhardwaj in his report, the minister said the government will look into it and decide. But he indicated that there could be crossover of MLAs to the party from the opposition camp saying Congress and JD(S) MLAs are upset with the way their party leaders are trying to destabilize the BJP government. He, however, thanked the Union government for rejecting the governor's report saying it is a victory for democracy.
