Highlights of Rhea Chakraborty’s bail order

Rhea Chakraborty was granted bail by the Bombay High Court today in an order pronounced by Justice Sarang V Kotwal. She was arrested by the Narcotics Control Bureau on September 8 and sent to Byculla jail. After nearly a month, Rhea got some relief as the HC granted her bail. Take a look at the highlights of Rhea’s bail order.

The Bombay High Court in its bail order observed that the NCB’s probe did not recover any psychotropic substance from Rhea Chakraborty, “The investigation did not reveal any recovery (of commercial quantity of a Narcotic drug) either from the Applicant or from the house of Sushant Singh Rajput. It is their own case that the drugs were already consumed and hence there was no recovery. In that case, there is nothing at this stage to show that the Applicant had committed any offence involving commercial quantity of contraband.” The order also turned down the ‘drug syndicate’ theory and stated, “She is not part of the chain of drug dealers.”

The judge also disagreed with the Additional Solicitor General of India's argument that celebrities and role models should be treated harshly so that it sets an example for the young generation. The bail order stated, "Everybody is equal before law. No celebrity or role model enjoys any special privilege before the Court of law. Similarly, such person also does not incur any special liability when he faces law in the Courts. Each case will have to be decided on its own merits irrespective of the status of the accused."

Justice Sarang Kotwal, while granting bail to actor Rhea Chakraborty, said in his judgement, "She has not forwarded the drugs allegedly procured by her to somebody else to earn monetary or other benefits. Since she has no criminal antecedents, there are reasonable grounds for believing that she is not likely to commit any offence while on bail."

Rhea Chakrabroty was asked to furnish Bail amount of one lakh and also deposit her passport with the investigating agency. She was also asked to attend the office of the investigating agency on first Monday of every month between 10:00 a.m. to 11:00 a.m. to mark her presence, for a period of six months. While for a period of 10 days after her release, the court asked Rhea to present herself to the nearest police station. The order also observed that Rhea shall not tamper with the evidence or investigation of the case.
