Karnataka HC orders notice to Ashoknagar police in Bengaluru on cricketer Amit Mishra’s plea

BENGALURU: The Karnataka high court has ordered notice to Ashoknagar police in Bengaluru city in response to a fresh petition filed by Amit Mishra,Leg spinner and a team India member.In his petition, Mishra has challenged the charge sheet filed by the police on October 30,2015 and the order of taking cognizance of the same on November 7,2015 by the trial court for the alleged offences punishable under sections 323, 325, 504, 509 and 354-A (IV) of IPC in pursuance of the complaint lodged by one Vandana jain.According to Mishra , the very complaint on the basis of which the Police Registered the case and progressed with the investigation and ended up filing a Chargesheet is highly condemnable and carried no grounds for considerations.He adds that on the contrary, the very contents of the said complaint gave many grounds for the police to register a case of trespass and mischief against her and the management of the Ritz Carlton Hotel.“The act of the police clearly sounds like accepting the complaint of a burglar and registering a case against the owner of the house burgled “ he has stated in his petition.Mishra has stated that on September 27,2015 when he tiredly returned to the Hotel room, after participating in a cricket fitness camp, he was shocked see Vandana Jain sitting his room.He adds that it was clear that she had trespassed into the security held hotel room in his absence, by gaining illegal entry and being flabbergasted by this, he immediately called the hotel staff and confronted her as to how she could gain entry into his room and reprimanded her for the illegal act and expressed that he would be filing complaint against her and the Hotel Management.He further says that Vandana tried to explain by weeping that she was his fan and there was no other way she could come close to him.
