Are your tolls unpaid? New government rules make toll clearance mandatory before selling your vehicle or renewing fitness certificate

The Indian government has taken a crucial step regarding the collection of tolls on National Highways. For a toll-free road system to become a reality, the Ministry of Road Transport and Highways (MoRTH) has modified the Central Motor Vehicles Rules of 2026. According to the new rules, owners are required to pay all pending toll taxes before either selling the vehicle or obtaining a fitness certificate. Such a step has been taken to meet the existing issues regarding toll payments, to curb the occurrence of toll payment evasion, and for all road users to make fair contributions.Through enforcement of the mandatory toll clearance, the government expects to ensure a smooth, fast, and seamless travel experience for commuters on the country’s roads. The move also strengthens digital tracking, boosts transparency, reduces disputes, supports infrastructure funding, and aligns highway management with reforms nationwide.With the new rules, car owners must ensure that all pending toll payments are cleared before the completion of some essential administrative tasks. These tasks include the transfer of ownership of a car and the issuance/renewal of a fitness certificate.As PTI reported, these regulations are applicable to all road-going vehicles using toll roads all over the country. This not only ensures that the regulations are followed but also ensures that tolling is closely linked with vehicle administration, which is an efficient system of enforcement.As per MoRTH, this move seeks to optimise compliance with user fees, optimise the efficiency rate of Electronic Toll Collection systems, and discourage evasion on National Highwayways. The linkage between toll charges and important legal procedures implies that loopholes are being sealed by the regulatory bodies to evade payments by vehicle owners.Electronic Toll Collection is one of the key factors of the Indian government's strategy to modernise highway infrastructure. An RFID-enabled tag fitted in vehicles enables ETC systems to automatically pay tolls without congestion, thereby avoiding the need for manual cash transactions at collection booths.But despite technological advancements, toll evasion persisted. The new rule will address this as it tries to make Toll clearance a prerequisite for completion of major administrative actions related to vehicles. It is believed that this would ensure timely payment of tolls, speed up the implementation of cashless tolling, and, ultimately, reduce congestion at the toll plaza itself.A major issue on the National Highways is toll evaders. Car owners were trying to change the ownership of their vehicles or postpone the administrative formalities to escape paying accumulated toll dues. The proposed amendments clearly counter this problem by relating the dues to the basic processes required for every vehicle.Through the imposition of a legal consequence for non-payment of tolls, the government is clearly sending out the message of the non-negotiable nature of road use charges. The government also sends out a message of equity to all road users because all road users contribute equally to the development of the road infrastructure.It adds an extra feature of responsibility for the car owner. An owner will be required to check if their toll dues are cleared before either selling the vehicle or getting a fitness certificate. It will therefore encourage the regular checkup of the toll accounts.Although this can initially be viewed as a further process, it further integrates the objective of having a seamless, transparent, efficient, and modern tolling system in general. As a result, there will be less potential for a dispute in the non-payment of tolls in the long run.
