The Trichy crime branch police registered an FIR against Dhinakaran and Senthil based on a complaint filed by AIADMK MP P Kumar.
Justice S S Sundar stayed the FIR after he hearing a petition filed by Senthil.
Kumar had lodged a complaint with the Trichy crime branch police saying that Senthil gave an interview to a private television channel on August 31. He said the actor had made derogatory remarks against him and his words had provoked the supporters of Dhinakaran against the MP. He had done all these due to instigation by Dhinakaran, Kumar said.
The police registered a case under sections of 294 (b), 153, 506 (i) and 109 of IPC against the actor and Dhinakaran.
The actor’s counsel said it was an admitted fact that the alleged incident had taken place in Chennai. Thus, the Trichy police had no jurisdiction to register the complaint. Besides, due to political motive, the MP gave a complaint against the petitioner and others. However, the police, without even conducting any preliminary inquiry, had registered the case against the petitioner and others, the counsel said.
Further, the petitioner is a known face in
Tamil Nadu and neighbouring states as he acted in hundreds of films. He said the FIR was illegal, erroneous and contrary to the facts and circumstances. Besides, in the present political scenario, there were chances that the petitioner and Dhinakaran would be arrested. The court needed to restrain the police from arresting them, the counsel said.
Following this, the court stayed the FIR and ordered notice to the police and the complainant.
