new delhi: while announcing the implementation of mcoca in delhi, police commissioner ajai raj sharma said the new act was necessary since "organised crime has no boundaries". stating that it is too early to enact such a law in delhi, legal experts denounce the commissioner's theory. supreme court advocate rajeev dhawan states the commissioner's theory is no explanation to justify the implementation of mcoca.
senior criminal lawyer p n lekhi, however, calls the commissioner's justification as phantoms. "let the police commissioner first get officers who are capable of tackling the gangsters who indulge in organised crime," lekhi says. lawyers state the definition of congnizable offence under mcoca is wide. "it can be social or political offence. mcoca is something which can cover anybody who has the misfortune of being chargesheeted but acquitted," dhawan says.
