Hyderabad: Telangana high court on Tuesday refused to interfere in the order of a single judge who gave the go-ahead to Nalgonda municipal commissioner to demolish the BRS office building in the town.
Stating that Telangana Building Rules-2012 too cannot come to the rescue of the BRS building, a bench of Chief Justice Alok Aradhe and Justice J Sreenivas Rao, however, set aside the Rs 1 lakh penalty slapped by the single judge on BRS.
In the absence of any statutory provision, BRS has no right to seek regularisation of the construction which has already been raised, the bench said. Telangana Building Rules permit regularisation of constructions made in violation of the building permission. "Even these rules have no application to a case where the building permission is not obtained at all," the bench said while disposing of BRS's plea.
