Kolkata Rape and Murder Case Live Updates: Junior doctors continued their protest outside the police headquarters in Kolkata's Lalbazar area, demanding the resignation of police chief Vineet Goyal over alleged inaction against the mob violence at RG Kar Hospital on August 14. Before the Supreme Court hears the rape-murder case on September 5, the victim’s family will join the protesting doctors at RG Kar Medical College & Hospital on Wednesday. Trinamool and BJP joined hands to ensure the unanimous passage of the Aparajita Bill in the state assembly on Tuesday. Kolkata Doctor Rape Case Live: Aparajita Bill, with death for rape, set to tabled in House today

  • The bill will seek to amend the Bharatiya Nyaya Sanhita and the Bharatiya Nagarik Suraksha Sanhita as well as parts of the Pocso Act of 2012 and introduce the death penalty in several types of sexual assault cases irrespective of the vic tim’s age.
  • The Aparajita Bill will seek that these crimes are punished only with death. The bill will also seek death for gang rapes [BNS Section 70(1)].
  • The Aparajita Bill will also ask for longer prison terms for disclosing a rape survivor’s identity (three to five years instead of the BNS punishment of two years).
  • It proposes to make “printing or publishing any matter regarding court proceedings without permission” punishable with three to five years in jail, from the maximum two years in BNS.

The junior doctors on Monday marched to Lalbazar carrying roses and a replica of the human spine, demanding the resignation of Kolkata Police commissioner Vineet Goyal. The protest continued till late into the night as the doctors demanded to meet Goyal at the protest site on BB Ganguly itself if they were not allowed to march till Lalbazar.

Senior health department officials will meet on Tuesday to decide Ghosh’s fate. A 48-hour custody will lead to immediate suspension, but the state may not wait that long, said sources. Trinamool’s former MP, Kunal Ghosh, said: “He has been arrested, possibly on a corruption charge. He and his lawyers will speak on the matter. The party has nothing to say. These charges (against him) were heard long back. Had Swasthya Bhavan acted on them, they could have averted this embarrassment.” On August 24, the anti-corruption branch of CBI registered an FIR into alleged financial irregularities at RG Kar following an order from Calcutta High Court. The agency named Ghosh in the FIR, apart from another individual — Khama Louha — and two companies (Ma Tara Traders and Ehsan Cafe). While CBI officers started looking into alleged irregularities at the college and hospital, they came across vendors who were handed out contracts amounting to crores without bids and illegal sales of medicine and medical equipment allocated to the hospital.

Bengal's Aparajita Bill, with death for rape, set to be tabled in House today

MLAs on Monday got a draft copy of the Aparajita Bill, which seeks to punish all incidents of rape - including cases where the woman survives - with death or life in prison. State law minister Moloy Ghatak is likely to table the Aparajita Women, Child (West Bengal Criminal Law Amendment) Bill 2024 in the assembly on Tuesday.

On the first day of the Bengal assembly’s special session on Monday, tension ran high as the RG Kar incident dominated the proceedings.
Although the session was supposed to be adjourned after a condolence motion, the lack of mention of the victim in the motion — which only included late former CM Buddhadeb Bhattacharjee — sparked objections from BJP legislators. Leader of opposition Suvendu Adhikariinsisted that the RG Kar victim also be acknowledged. When Speaker Biman Banerjee clarified that the victim’s name could not be included due to legal constraints, a heated exchange ensued between Trinamool and BJP legislators. Ultimately, the woman’s name or any reference to the crime was not added to the motion.
West Bengal law minister Moloy Ghatak today introduced the anti-rape bill at the state Assembly special session. Discussion on the bill is expected to take place for around two hours in which BJP MLAs Sikha Chatterjee and Agnimitra Paul are scheduled to speak beside the leader of opposition Suvendu Adhikari. Parliamentary affairs minister Sobhandeb Chattopadhyay and chief minister Mamata Banerjee will be the speakers for the government. The proposed legislation seeks capital punishment for persons convicted of rape if their actions result in the victim's death or leave her in a vegetative state. Additionally, it stipulates a life sentence without parole for those convicted of rape and gang rape.Titled the 'Aparajita Woman and Child Bill (West Bengal Criminal Laws and Amendment) Bill 2024,' the legislation aims to strengthen protections for women and children by revising and introducing new provisions related to rape and sexual offences. A two-day special session of the Assembly has been summoned on Monday in the wake of the rape-murder of a woman medic at the state-run RG Kar Medical College and Hospital last month.

Meanwhile, Sandip Ghosh, the former principal of RG Kar Medical College and Hospital, was placed in eight-day custody on Tuesday following his arrest by the Central Bureau of Investigation (CBI) in connection with alleged financial misconduct at the state-run facility.
