Tesla CEO Elon Musk has now launched a new attack on Sam Altman’s OpenAI. In a newly released testimony from his lawsuit against OpenAI, Elon Musk has sharply criticised the company’s safety record, contrasting it with his own AI venture xAI. Musk has claimed that while OpenAI’s ChatGPT has been linked to incidents of self-harm, ‘Nobody has committed suicide because of Grok.’ ChatGPT-maker OpenAI now faces multiple lawsuits alleging that that the manipulative conversations of ChatGPT has contributed to negative mental health outcomes including suicides. The deposition by Musk suggests that these cases could bolster his argument that OpenAI’s commercial pivot comprised safety in favour of speed and profit.

xAI under scrutiny

Despite Elon Musk’s defense of Grok, xAI has faced its own controversies. Last month, Musk’s social media network X (formerly known as Twitter) was flooded with non-consensual nude images generated by Grok, some allegedly involving minors. The incident triggered investigations by the California Attorney General and regulators in the EU, with some governments imposing bans.





Musk reiterated that OpenAI was originally founded as a counterweight to Google, which he believed was not taking AI safety seriously. He admitted he was mistaken about his supposed $100 million donation to OpenAI, with filings showing the figure closer to $44.8 million. He also acknowledged the risks of artificial general intelligence (AGI), saying it “has a risk” if not properly managed.

Judge dismisses Elon Musk’s lawsuit against OpenAI

A federal judge in California has dismissed a lawsuit filed by Elon Musk’s AI company xAI’s against ChatGPT-maker OpenAI, reported Reuters. US District judge Rita Lin said that xAI has failed to allege that the Sam Altman-led company committed any misconduct, the news agency said. The lawsuit, originally filed in September 2025, claims that xAI employees who left the company for new jobs at OpenAI took source code related to its Grok chatbot and other confidential information with them. Dismissing the lawsuit, the judge said that the Elon Musk's xAI can refile the case.

What the judge said dismissing lawsuit against OpenAI

As quoted in the Reuters report, judge Lin said “Notably absent are allegations about the conduct of OpenAI itself.”

“xAI does not allege any facts indicating that OpenAl induced xAI's former employees to steal xAl's trade secrets or that these former xAI employees used any stolen trade secrets once employed by OpenAI. While xAI may state misappropriation claims against a couple of its former employees, it does not state a plausible misappropriation claim against OpenAI, which is the sole defendant in this case. Accordingly, and for the reasons set forth below, OpenAI's motion to dismiss is GRANTED WITH LEAVE TO AMEND.”
