The Right to Privacy is human right that restrains government and private actions, which causes a threat to the privacy of individuals. It depends on no instrument or charter. This privacy may have several aspects, including bodily integrity, personal autonomy, informational self-determination, protection from state surveillance, dignity, confidentiality, compelled speech and freedom to dissent or move or think.
The Supreme Court on August 24, 2017 pronounced that the Right To Privacy is a fundamental right protected under the Indian Constitution. The judgement was delivered by a nine-member bench and is based on an array of petitions that challenge the mandatory use of Aadhaar cards which assign a unique 12-digit ID to every citizen.
This outright judgement was given in order to deal with a batch of petitions challenging the Centre's move to make Aadhaar mandatory for availing the benefits of various social welfare schemes. Petitioners say that enforcing the use of Aadhaar is an infringement of privacy. They also stressed that the Aadhaar database was originally presented as a purely voluntary programme that offered to provide every Indian with an identity card.
