SC Flags “Very Unusual” Situation, Seeks Remedy Over Mamata ‘Obstructing’ ED Charge

West Bengal Chief Minister Mamata Banerjee and the state government have opposed a plea by the Enforcement Directorate in the Supreme Court, questioning its maintainability under Article 32. The state argued that central agencies cannot claim “fundamental rights” to conduct investigations or seek writ remedies. It warned that granting such status to agencies like the ED, CBI, CID and SFIO would weaken India’s federal structure by enabling government bodies to file cases against each other. The matter was heard by a bench of Justices Prashant Kumar Mishra and N V Anjaria. The case assumes significance amid growing friction between the Centre and opposition-ruled states over the use of investigative agencies.
