Dehradun: The single bench of Justice Pankaj Purohit on Tuesday directed the
CBI to inform the court within 15 days about the current status of the case against accused
Anant Kumar Singh, the then DM of Muzaffarnagar, while hearing the matter regarding punishment for the accused in the Rampur Tiraha incident of UP that occurred during the state movement on Oct 2, 1994.
On behalf of petitioner Raman Sah, it was submitted that the court had previously directed the parties to apprise it of the status of this case, but no response was received either from the UP govt or from the CBI. Whereupon, the court directed the CBI to inform it of the current status of the case. The petitioner submitted that the status of Anant Kumar case cannot be ascertained, nor has the court been apprised of it to date.
In response, the CBI submitted that before the state was formed, the case was heard in the
Supreme Court. The SC sent the matter for inquiry to Allahabad High Court. The HC forwarded it to the registrar of Uttarakhand HC. On their recommendation, all the files were transferred from the Dehradun court to Muzaffarnagar. The CBI requested that time be granted to ascertain what happened in these cases thereafter. The court accordingly granted the CBI 15 days to apprise it of the status.
According to the matter, Raman Sah, president of the Uttarakhand Andolankari Adhivakta Manch, challenged in the HC the order of the court of the District Judge and Special Judge, CBI, Dehradun, transferring the case related to the Muzaffarnagar incident from Dehradun to the Muzaffarnagar court.
The petitioner stated that on Oct 2, 1994, during the Uttarakhand movement, hundreds of Uttarakhandis travelling to Delhi were subjected to brutal treatment at Rampur Tiraha, Muzaffarnagar. Following a CBI investigation into the matter, it had filed a chargesheet against the accused under section 304 in the Dehradun court, of which the court had taken cognisance under section 302.
In this matter, advocate Raman Sah had filed a petition in the SC. However, the SC granted liberty to file the petition in the HC, following which the matter was filed. Meanwhile, Singh, the then DM of Muzaffarnagar, is now retired.
