The first application has been moved in the light of the July 24, 2010 order of the bench comprising Justice SU Khan, Justice Sudhir Agarwal and Justice DV Sharma, stating: "Until delivery of judgment, the parties are at complete liberty to contact the OSD for formation of a bench in case some possibility of compromise, reconciliation emerges ..."
The applicant has been filed on behalf of Ramesh Chandra Tripathi - defendant number 17 in the title suit: Sunni Central Board of Waqf v/s Gopal Singh and Others - with the special bench OSD HS Upadhyay. Tripathi has submitted before the court to direct the parties concerned to resolve the issue among themselves across the table in larger interest to prevent imminent public unrest which may erupt following the verdict. The application has been filed under the provisions of the Section 89 of the Civil Procedure Code (CPC) which provides for such applications by any of the parties concerned.
The other two applications have been filed by Sunder Lal Jain and Sudesh Kumar Sharma in public interest which is admissible under Section 151 of the CPC. In his submission, Sunder Lal stated that a heavy inflow of foreign nationals and sportspersons into India was expected for Commonwealth Games (CWG) to be inaugurated on October 3 next. Any disturbance at the law and order front arising out of the verdict, may cause embarrassment to the country at the international level, the application says.
